DANIEL AVERY PRIZE DRAW TERMS AND CONDITIONS
Promoter: PIAS UK Limited, a company registered in England and Wales with number 02685907 whose registered office is at 1 Bevington Path, Bevington Path, London, SE1 3PW (“Promoter”). Promoter’s decisions are final and binding in all matters relating to the Daniel Avery prize draw; referred hereafter as the “Prize Draw”.
Prize Draw Entry Period: The Prize Draw will begin on 10th November 2022 at 9:00am (GMT) and the deadline for receipt of entry is 11th November 2022 at 09:00am (GMT) (the “Prize Entry Period”).
Eligibility: Prize Draw is open to any person who has reached the age of 16 or older (entrants under the age of 18 must have valid written consent from a parent or guardian before entering the prize draw, which will need to be evidenced to reclaim any prize won and Promoter may require proof that you are eligible to enter the competition) who resides in the United Kingdom (defined as England, Northern Ireland, Scotland and Wales). Employees of the Promoter and its respective parent company, subsidiaries, affiliates, advertising and promotion agencies, and any other individual or company involved in the development or execution of the Prize Draw (collectively the “Released Parties”) and their immediate family members and/or those living in the same household of each are not eligible to enter or win. Prize Draw is subject to all applicable territorial and local laws and regulations.
To Enter: Access to the internet is required to enter this Prize Draw. Visit https://danielavery.ochre.store/no-purchase-necessary and follow all onscreen instructions to enter.
Limit: Entries received after the end of the Prize Entry Period are automatically disqualified. Only complete and valid entries as determined by the Promoter will be eligible for the Prize Draw.
Winner Selection: 1 winner will be notified by email by a [PIAS] representative by 18th November 2022 11:59 PM (GMT) whose decisions are final and binding. The notified winner will need to respond to Promoter within forty-eight (48) hours with their email address. If a winner is otherwise eligible under these Rules, but is nevertheless under the age of 18 in his or her locale of primary residence at the point of entering this Prize Draw, winner's parent or legal guardian is required to execute any required document on such winner’s behalf . If any winner fails to respond to the direct message and prize notification sent to them by email within forty-eight (48) hours of transmission or if prize notification email is returned as undeliverable or if potential winner is otherwise found to be ineligible; or if the selected potential winner cannot accept or receive the prize for any reason; or if the prize is returned undeliverable the potential winner will forfeit the prize and an alternate winner will be selected from all non-winning eligible Entries . The alternate winner will be notified and be bound by the same conditions and timelines as stated in these terms and conditions. The Promoter reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any.
Prize & Approximate Retail Value (“ARV”): The winner shall each receive 1x signed test pressing, and a place on the guestlist for either the show in London on 2nd December 2022 or Glasgow on 3rd December 2022, including a chance to watch the soundcheck. Transport costs to and from the event are not included in the prize, nor any other costs incurred in relation to the show. Prize is not redeemable for cash. Prize is non-assignable and non-transferable. Entrants acknowledge that the Promoter and all other businesses concerned with this Prize Draw and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of a prize except that each merchandise prize shall be subject to any applicable manufacturer’s standard warranties.
Consent and Release: Promoter will not in any circumstances be liable to compensate the winner or accept any liability for any loss, damage, disappointment or injury occurring as a result of entering the Prize Draw or taking up the prize. Nothing in these Rules shall limit in any way any party’s liability under U.K. law for death or personal injury caused by its negligence. Nothing in these terms and conditions shall affect your statutory rights. Promoter is not responsible for any suspension of the Prize Draw or inability to implement the Prize Draw or award the prize as contemplated herein due to any event beyond its control, including delays or interruptions caused by acts of God, acts of war, natural disasters, weather, utility outages, acts of terrorism or any local government law, order, or regulation, order of any court or regulator. This Prize Draw shall be governed by and interpreted under the laws of the England and Wales, without regard to its conflicts of laws provisions. Any and all disputes, claims, and causes of action arising out of or in connection with this Prize Draw, shall be resolved individually, without resort to any form of class action. Or, mandatory local law provisions outside of England and Wales law provisions as per the stated governing law may apply.
Personal Information & Privacy: Any personal information provided hereunder will be subject to Promoter’s privacy policy at https://www.piasgroup.net/privacy-and-cookies-policy/ and Show.co privacy policy at https://www.show.co/privacy-policy/. Promoter will collect, process and use the data provided concerning the Participant and transfer such personal data to the U.K. for purposes of management of the Prize Draw; it is not possible for you to participate in the Prize Draw without your personal data being processed in this way.
Severability: If any provision or part-provision of these terms and conditions is held by any court to be invalid, illegal or unenforceable, it shall be struck out but shall not affect the validity or enforceability of any and all remaining provisions.
